Welcome to the Buckworths Limited privacy policy (the “Privacy Policy”).

Buckworths Limited (company number 07541905) (collectively referred to as “Buckworths”, “we“, “us” or “our” in this Privacy Policy), respects your privacy and is committed to protecting your Personal Data. This Privacy Policy will inform you how we look after your Personal Data when you visit our Website, regardless of where you visit it from and tells you about your privacy rights and how the law in our jurisdiction protects you.

Capitalised terms used herein shall have the meanings given in our Terms which can be found here. Save for the following:

Anonymous Data” means Personal Data that has been amended to the extent that it no longer contains any identifying information and thus, no longer constitutes Personal Data;

Children” any person under the age of 18;

Controller” means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any Personal Data are, or are to be, processed as outlined in the Data Protection Legislation;

Data Protection Legislation all applicable data protection and privacy legislation in force from time to time in the UK including the General Data Protection Regulation ((EU) 2016/679); the Data Protection Act 2018; the Privacy and Electronic Communications Directive 2002/58/EC (as updated by Directive 2009/136/EC) and the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended;

Personal Data” has the meaning given to it in the Data Protection Legislation; and

Processor” means any natural or legal person who processes the data on behalf of the Controller.

1. Important information and who we are

Purpose of this Privacy Policy

This Privacy Policy aims to give you information on how Buckworths collects and processes your Personal Data through your use of our Website, including any Personal Data you may provide through the Website when you make an enquiry or sign up for an event.

The Website is not intended for Children and we do not knowingly collect data relating to Children. Buckworths accepts no liability for the processing of any data relating to Children where they were not aware at the time that the subjects were Children.

It is important that you read this Privacy Policy together with any other privacy policy or fair processing notice we may provide on specific occasions when we are collecting or processing Personal Data so that you are fully aware of how and why we are using your Personal Data. This Privacy Policy supplements the other notices and is not intended to override them unless specifically stated.

Controller

Buckworths is a data Controller in respect of certain Personal Data provided by Users via the Website and by email and by third parties including suppliers and clients, provided through a variety of methods. Buckworths is a data Processor in respect of any Personal Data processed by Buckworths on behalf of any Users.

Changes to the Privacy Policy and your duty to inform us of changes

It is important that the Personal Data we hold about you is accurate and current. Please keep us informed if any aspect of your Personal Data changes during your relationship with us. Any previous data held on you will be deleted to the fullest extent possible.

Third-party links

The Website may include links to third-party websites, plug-ins and applications. Clicking on any of these links or enabling those connections may allow third parties unassociated with Buckworths to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements.

We encourage you to read the privacy policy of every website you visit, but, for the avoidance of doubt, Buckworths accepts no liability for any Personal Data or other data which is unlawfully processed by third parties as a result of you accessing these links.

2. The data we collect about you

We may collect, use, store and transfer different kinds of Personal Data about you, which include but are not limited to, the following categories:

  • Identity Data: means data that includes your name, the name of the business you may contact us on behalf of and any other information that may be used to identify you.
  • Contact Data: means data that includes your contact information, such as your email address and/ or your telephone number.
  • Technical Data includes internet protocol (IP) addresses you may have visited, the type and version of browser you are using, the time zone setting and location from which you are accessing the Website, browser plug-in types and versions, which operating system and platform are being used and other technology on the devices you use to access the Website.
  • Usage Data includes information about how you use the Website and our services such as the full uniform resource locations (URL) clickstream to, through and from the Website (including date and time), pages you viewed or searched for, page response times, download errors, length of visits of certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
  • Marketing and Communications Data includes your preferences in receiving marketing communications from us and/ or our third parties and what are your communication preferences.

We may also collect Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your Personal Data (which has been collected and processed lawfully) but is not considered to constitute Personal Data under the Data Protection Legislation. This is because the data does not directly or indirectly reveal your identity.

For example, we may aggregate your Usage Data to calculate the percentage of Users accessing a specific Website feature. This will help us to ensure that we are responding to the preferences of our Users and delivering the best possible services and Website. However, if we combine or connect Aggregated Data with your Personal Data in any way so that it can directly or indirectly identify you, the combined data will be considered Personal Data which will only be used in accordance with this Privacy Policy.

We do not collect any Special Categories of Personal Data about you. Special categories mean the kinds of data recognised by the Data Protection Legislation as being more sensitive in nature than Personal Data, this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. Nor do we collect any information about whether you have any prior criminal convictions and/or offences.

If you fail to provide Personal Data

Where we need to collect Personal Data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In this case, we may have to cancel any agreement for services you have with us but we will notify you if this is the case at the time of contracting.

For the avoidance of doubt, Buckworths accepts no liability for any losses arising from their inability to fulfil any contractual requirement as a result of your failure to provide the data required.

3. How is your Personal Data collected?

We use different methods to collect data from and about you including through:

  • Direct interactions. You may give us your Identity and Contact Data by corresponding with us by post, phone, email or otherwise. This includes Personal Data you provide when you:

    • register for an event run by us; or

6. Disclosures of your Personal Data

  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Data in the same way as set out in this Privacy Policy.

We may sell data derived from usage of the Website and views and downloads of pages, profiles and adverts on the Website, which will always be in aggregated and anonymised form to customers, purchasers and retailers.

9. Data retention

How long will you use my Personal Data for?

We will only retain your Personal Data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Once these have been satisfied the Personal Data will either be deleted or amended to the extent that it would be considered Anonymous Data.

10. Your legal rights

Under certain circumstances, you have rights under the Data Protection Legislation in relation to your Personal Data.

You have the right to the following requests:

  • Access Request to your Personal Data (commonly known as a “data subject access request“). This enables you to receive a copy of the Personal Data we hold about you.
  • Correction Request of the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Erasure Request of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. No fee usually required

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month of the time we receive all of the information required to complete your request. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
